By clicking "I agree" (or a similar button or checkbox) and starting a paid subscription, you ("Client") agree to these Terms of Service ("Terms") on behalf of your business. Your electronic acceptance has the same legal effect as a handwritten signature. The Client is identified by the account (email and business ID) used to accept these Terms and to subscribe through MyTurn.
If you do not agree to these Terms, do not subscribe to or use the paid MyTurn service.
Eldar Studio LLC ("we," "us") provides access to the MyTurn platform, a cloud-based queue and appointment management system for barbershops, including:
We may add, change, or remove features over time. We do not guarantee that any specific feature will remain available.
Subscription fee. The Client agrees to pay a monthly subscription fee of $10.00 USD per active barber chair, per month ("Founding Client rate"). This rate is locked for the Client for as long as the subscription remains continuously active and is not cancelled.
Active barber chair. An "active barber chair" is a barber (staff member) who is enabled in the Client's MyTurn account at the time the monthly invoice is generated. The number of active chairs may vary month to month as the Client adds or removes barbers, and the monthly fee adjusts accordingly.
Free trial. If a free trial period is offered to the Client, its length will be shown at checkout before any payment is required. Billing begins at the end of the trial period. Not all subscriptions include a free trial.
Billing. Payments are processed monthly through Stripe and are charged on the same day each month as the subscription start date. The Client authorizes Eldar Studio LLC to charge the payment method on file for the applicable monthly fee.
Late payment. If a payment fails or is not completed, access to the service may be suspended after 7 days.
This Agreement begins on the date of electronic acceptance and continues on a month-to-month basis. Either party may cancel with 15 days' written notice via email. No refunds will be issued for partial months.
Eldar Studio LLC does not guarantee uninterrupted service and is not responsible for any lost revenue, lost clients, or business interruption due to platform downtime, SMS delivery failures, or technical issues beyond our control.
In no event shall Eldar Studio LLC's total liability exceed the amount paid by the Client in the prior 30 days.
The MyTurn platform, including all software, design, and features, remains the exclusive property of Eldar Studio LLC. The Client is granted a limited, non-transferable license to use the platform for the duration of this Agreement.
Eldar Studio LLC will not share or sell Client business data or customer information to third parties. Client data is stored securely via Google Firebase.
SMS consent is obtained by MyTurn directly from the end customer, through the optional consent checkbox presented on the MyTurn check-in kiosk, and MyTurn is responsible for that consent and for honouring opt-out requests. The Client does not collect SMS consent on MyTurn's behalf and must not send messages through the platform to numbers obtained by any other means.
The Client remains responsible for informing its own customers about the Client's own data collection, and for any consent required by law in connection with information the Client gathers or uses outside the MyTurn platform.
This Agreement shall be governed by the laws of the State of Maryland, United States. Any disputes shall be resolved in the courts of Maryland.
We may update these Terms from time to time. If we make a material change, we will notify the Client and may require acceptance of the updated Terms to continue using the paid service. Each version of these Terms is identified by a version number and effective date. The version the Client accepts at the time of subscription, as recorded by us, governs the relationship until a new version is accepted.
These Terms constitute the entire agreement between the parties and supersede all prior discussions or agreements. These Terms may only be modified as described in Section 8.
